Terms of Service

These Terms of Service (hereinafter referred to as the “Terms”) apply to all users (hereinafter referred to as “Users”) who use the digital content sales service (hereinafter referred to as the “Service”) provided by the Polarix Audio site (hereinafter referred to as the “Site”). Users shall use the Service upon agreeing to these Terms.

1. Application

  1. These Terms establish the conditions regarding the purchase and use of digital content provided by the Site.
  2. By using the Service, the User is deemed to have agreed to these Terms.

2. Definitions

 The definitions of terms in these Terms are as follows:

  • Digital Content: Refers to all electronic products sold by the Site, including music, video, books, software, images, templates, etc.
  • Purchase: Refers to the act of the User acquiring Digital Content through the Site.
  • Download: Refers to the act of saving the purchased Digital Content to the User’s own device.
  • Account: Refers to an account created based on registered personal information, which is necessary for the User to use the Service.

3. Service Content

  1. The Site provides a service for selling Digital Content online.
  2. Users may purchase and download Digital Content provided on the Site.
  3. The Site may change the product lineup, prices, or service content at any time and bears no obligation to notify Users regarding such changes.

4. Account Creation

  1. Users may be required to create an account to purchase content through the Site.
  2. When creating an account, Users are obligated to provide truthful and accurate information.
  3. Users are responsible for managing information related to their account (login ID, password, etc.) and must not transfer or lend this information to any third party.
  4. If there is unauthorized access to an account, the User shall immediately notify the Site and follow its instructions.

5. Purchase of Digital Content

  1. Users may purchase Digital Content provided on the Site.
  2. A sales contract is deemed to be formed between the User and the Site at the time the purchase procedure is completed.
  3. Users shall use the payment methods designated by the Site (credit card, electronic money, etc.) for the purchase of Digital Content.
  4. Upon completion of payment, the User will receive a download link from the Site and may download the purchased content.

6. Cancellation, Return, and Refund after Purchase

  1. Due to the nature of Digital Content, returns and cancellations are not accepted.
  2. Users shall confirm the details of the product (specifications, format, etc.) before purchasing and shall proceed with the purchase only upon consent.

7. Restrictions on Use of Content

  1. Users may use the purchased Digital Content regardless of whether for personal or commercial purposes, provided that such use is limited to use by the User themselves.
  2. Users are prohibited from copying, redistributing, lending, or reselling the purchased content.
  3. Users must not infringe upon the copyrights or other intellectual property rights of the content provided by the Site.

8. Copyright and Intellectual Property Rights

  1. All copyrights and intellectual property rights of the Digital Content provided by the Site belong to the Site or its licensors.
  2. Users shall respect the rights held by the Site or its licensors regarding the purchased content and shall not infringe upon them.

9. Prohibited Acts

 Users shall not engage in the following acts:

  1. Acts that violate laws and regulations or public order and morals.
  2. Acts that infringe upon the rights of other Users or third parties.
  3. Acts that interfere with the operation of the Site, such as unauthorized access, attacks on the system, or falsification.
  4. Acts that damage the honor or credit of the Site.
  5. Other acts deemed inappropriate by the Site.

10. Modification and Suspension of Service

  1. The Site may change, suspend, or discontinue the content of the Service without prior notice.
  2. The Site bears no responsibility for any damages caused to Users due to the modification, suspension, or discontinuation of the Service.

11. Disclaimer

  1. The Site bears no responsibility whatsoever for any damages arising from the User’s use of the Service.
  2. The Site makes no warranty regarding the accuracy, safety, or use of the provided Digital Content. The Site bears no responsibility whatsoever even if problems occur regarding the content.

12. Handling of Personal Information

  1. The Site handles Users’ personal information appropriately in accordance with the “Privacy Policy.”
  2. Users guarantee that the personal information provided at the time of account creation and purchase is accurate.

13. Changes to Terms

  1. The Site may change these Terms at any time without prior notice.
  2. The content of the Terms after the change shall become effective at the time it is posted on the Site, and the User shall be deemed to have accepted the change by using the Service.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have exclusive primary jurisdiction by mutual consent over any dispute regarding the Service or these Terms.
